Gift Party Terms of Use

Welcome to Gift Party! These Terms of Service (“Terms”) govern your use of the Gift Party application (“App”), a Shop Mini that operates within the Shopify Shop app. By using Gift Party, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Gift Party, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Gift Party is a gift exchange coordination tool that allows users to:

• Create and join gift exchange groups
• Set budgets and deadlines for gift exchanges
• Receive random gift exchange pairings (Secret Santa style)
• View gift recommendations based on recipient preferences
• Track gift purchase completion status

3. Eligibility

You must be at least 13 years old to use Gift Party. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts and Conduct

When using Gift Party, you agree to:

• Provide accurate information in your profile
• Use the App only for its intended purpose of coordinating gift exchanges
• Respect other users in your gift exchange groups
• Not use the App for any unlawful purpose
• Not attempt to interfere with or disrupt the App’s functionality
• Not share group codes with individuals you do not wish to include in your gift exchange

5. Group Administration

If you create a gift exchange group, you become the group administrator and are responsible for:

• Managing group membership
• Setting appropriate budgets and deadlines
• Initiating the pairing process when ready
• Ensuring your group participants understand the gift exchange rules

6. Purchases and Transactions

Gift Party does not process payments or handle transactions. When you purchase gifts:

• All transactions occur through the Shopify Shop app
• Purchases are subject to individual merchant policies
• Gift Party is not responsible for product quality, shipping, returns, or refunds
• Any disputes regarding purchases should be directed to the merchant or Shopify

7. Intellectual Property

The Gift Party App, including its design, features, and content, is owned by Fyresite and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract the source code
• Use our trademarks without permission

8. Disclaimer of Warranties

Gift Party is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be available at all times
• The App will be error-free
• Gift exchange pairings will meet your specific preferences
• Other users will fulfill their gift exchange obligations

9. Limitation of Liability

To the maximum extent permitted by law, Fyresite and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Gift Party, including but not limited to:

• Disappointment from gift exchanges
• Failed or incomplete gift exchanges
• Actions or inactions of other group members
• Any purchases made through the Shop app

10. Termination

We reserve the right to suspend or terminate your access to Gift Party at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may stop using Gift Party at any time. To request deletion of your data, please contact us using the information below.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the “Last Updated” date. Your continued use of Gift Party after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
